With the following data protection information, we would like to inform you about how we handle your data when you use our website or our web shop www.jolly-designs.de (hereinafter: website). II. Encryption

All incoming and outgoing data is transmitted using TLS encryption. The security protocol "Transport Layer Security" (TLS) is a standard technology for secure data transmission on the Internet. You can recognize the encrypted connection when using our website by the fact that the address line of your browser begins with "https://" and by the encryption symbol located there. TLS encryption means that the transmitted data cannot be read by third parties.

III. Collection, processing and use of personal data

“Personal data” within the meaning of the GDPR means all information relating to an identified or identifiable natural person; a natural person is considered identifiable if he or she can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more special characteristics that express the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.

Your personal data will only be processed in accordance with the provisions of the applicable data protection law. Further information on the type, scope and purpose of the collection, processing and use of personal data can be found below:

  1. Types of data processed and purpose of processing when visiting our website

When you visit our website, the web server automatically records log files based on our legitimate interests in accordance with Art. 6 (1) (f) GDPR. These cannot be assigned to a specific person; this data includes, for example, browser type and version, language, operating system used, referrer URL (the previously visited page), IP address of the requesting computer, access date and time of the server request and the client's file request (file name and URL). This data is only collected for the purpose of statistical analysis and for security reasons (e.g. to investigate misuse or fraud) and is stored for a period of 7 days and then deleted. If longer storage of the data is necessary for evidentiary purposes, it is exempt from deletion until the respective incident has been finally clarified.

The hosting service provider for our website is Shopify International Limited, Victoria Buildings, 2nd Floor, 1-2 Haddington Road, Dublin 4, D04 XN32, Ireland ("Shopify"). All data collected on our website is processed on Shopify's servers; this is done on the basis of a data processing agreement, Art. 28 GDPR. In principle, you can visit our website without having to enter any personal data.

  1. Types of data processed and purpose of processing when registering and creating a customer account

You have the option of registering as a customer on our website and setting up a customer account. To do this, you must fill out the form under "Create account" with your first name, last name, email address, password and birthday. You can add your details when you log into your customer account for the first time. Mandatory fields are marked with [*Required]. Your full contact details will then be automatically adopted for every (subsequent) order. You can view your past orders via your customer account. In addition to the data mentioned under point 1, inventory data (e.g. name and address), contact details (e.g. email address) and payment details (e.g. bank details, account number and/or the card used for payment) will be processed. This data will only be processed for the purpose of pre-contractual measures or contract fulfilment in accordance with Art. 6 Para. 1 lit. b GDPR. The data stored in the customer account will be deleted after the time of termination, unless it is kept for purposes other than making it available in the customer account or must be kept for legal reasons.

  1. Use of cookies

We or third parties commissioned by us store so-called cookies on the customer's hard drive in order to make the use of our website more user-friendly and effective. The legal basis for this is Art. 6 Para. 1 lit. f GDPR.

A cookie is a small text file that is used, among other things, to collect information about the use of a website. These cookies cannot run programs or transmit viruses to your computer. They do not contain any personal data, cannot be assigned to specific people and, unless otherwise stated, are automatically deleted after one year at the latest. This data is not merged with other data sources.

IV. Data exchange with third parties, involvement of third countries in data processing

Subject to legal or contractual permissions, we process or have data processed in a third country only if the special requirements of Art. 44 et seq. GDPR are met in order to ensure the level of data protection. V. Disclosure of personal data

Your personal data will be passed on if this is necessary for the processing and fulfillment of contractual obligations, Art. 6 Paragraph 1 Letter b of GDPR. This particularly applies to logistics partners and payment service providers. The passing on of your personal data is limited to the minimum. Our contractual partners may only use this data to fulfill the order.

VI. Newsletter subscription

  1. We offer to inform you regularly by email about new products, interesting offers and current price developments. Subscribing to our newsletter is voluntary and takes place via the so-called single opt-in procedure. All you have to do is sign up for the newsletter on our website or during the ordering process. In order to be able to prove the subscription in accordance with legal requirements, the time of registration, confirmation time and the IP address are logged on the basis of our legitimate interests in accordance with Art. 6 Para. 1 lit. f GDPR. When registering for the newsletter, you consent to the processing of the data provided for sending or receiving emails, Art. 6 Para. 1 lit. a GDPR. You also consent to us collecting and processing data about your usage behavior (opening and clicking on links in the email) in order to be able to tailor the content of the mailings to your needs.
  1. You can revoke your consent to receive the newsletter at any time and without giving reasons with effect for the future via a link that you will find at the end of each newsletter or by sending an email to info@jolly-designs.com

We can store the unsubscribed email addresses and the data stored as part of the registration log for up to three years on the basis of our legitimate interests before we delete them for the purposes of sending the newsletter in order to be able to prove that consent was previously given. The processing of this data is limited to the purpose of a possible defense against claims. An individual request for deletion is possible at any time, provided that the previous existence of consent is confirmed at the same time.
  1. The newsletter is sent using “Klaviyo”, an email marketing service from Klaviyo, 49 Southwark Bridge Road, London SE1 9HH, England. The shipping service provider is used on the basis of our legitimate interests in accordance with Art. 6 Para. 1 lit. f GDPR and a contract for data processing in accordance with Art. 28 Para. 3 S. 1 GDPR. Your data is processed on the basis of our legitimate interests in accordance with Art. 6 Para. 1 lit f GDPR.

The shipping service provider can use the recipients' data in an anonymized form, i.e. without assigning it to a user, to optimize or improve its own services, e.g. for the technical optimization of the sending and presentation of the newsletter or for statistical purposes. However, the shipping service provider does not use the data of our newsletter recipients to write to them directly or to pass the data on to third parties.

VII. Direct marketing

  1. We also use your email address to advertise our own products that are similar to the products you have already purchased, provided you have consented to this, Art. 6 Paragraph 1 Letter a of GDPR. You can revoke your consent at any time and without giving reasons with effect for the future via a link that you will find at the end of every advertising email or by sending an email to info@jolly-designs.com.
  1. Direct advertising is also sent via “Klaviyo”. Section VI. 4 et seq. apply accordingly.

VII. Use of test seals

IX. Use of web analysis, remarketing and retargeting tools

Based on your consent in accordance with Art. 6 (1) (a) GDPR, we use various tools or plugins for web analysis, remarketing and retargeting to optimize our online presence and to be able to put together more targeted offers for you. Cookies are used, the IP address is forwarded and/or different types of data are recorded and evaluated. This includes, for example, the number of website visitors, length of visit, average page loading time, origin of visitors.

In detail:

  1. Google Analytics

We use Google Analytics, a web analysis service provided by Google Ireland Ltd. (“Google”), Google Building Gordon House, Barrow Street, Dublin 4, Ireland. Google Analytics uses cookies to help the website analyze how users use the site. The information generated by the cookie about your use of the website (including your IP address) is generally transferred to and stored by Google on servers in the United States. IP anonymization is activated on our website by adding the code “gat._anonymizeIp();” so that your IP address is transmitted in shortened form by Google within EU member states or other contracting states to the Agreement on the European Economic Area (so-called IP masking). Only in exceptional cases will the full IP address be transmitted to a Google server in the United States and shortened there. Google will use this information on our behalf to evaluate your use of the website, to compile reports on our website activities, and to provide other services related to website and internet usage.   1. Google Ads

We also use conversion tracking as part of Google Ads, an online advertising program from Google Ireland Ltd. (“Google”), Google Building Gordon House, Barrow Street, Dublin 4, Ireland.

If you click on an ad placed by Google, a cookie is set for conversion tracking. The information obtained using the conversion cookie is used to create conversion statistics, which we use to determine the total number of users who clicked on our ad and were redirected to a page with a conversion tracking tag. These cookies expire after 30 days and are not used to personally identify users. If you visit certain pages on our website and the cookie has not yet expired, Google and we can recognize that you clicked on the ad and were redirected to this page.

If you do not wish to participate in tracking, you can deactivate the Google Conversion Tracking cookie via your Internet browser under user settings and thus object to its use.   1. Facebook Custom Audiences

We use remarketing tags from the social network facebook.com of Meta Platforms Inc., 1601 Willow Road, Menlo Park, CA, 94025, USA ("Facebook"). The "Custom Audiences" feature used is a targeting option for advertisements to build our target group of Facebook users. When you visit our website, a direct connection is established between your browser and the Facebook server via the remarketing tags. This allows Facebook to assign the visit to our pages to your user account. We can use the information obtained in this way to display Facebook ads.

  1. Shopify

In addition, we use the statistics and analysis function of Shopify International Limited (2nd Floor Victoria Buildings, 1-2 Haddington Road, Dublin 4, D04 XN32, Ireland; “Shopify”) as part of order processing to analyze our website and its visitors.

For marketing and optimization purposes, the following data, among others, is stored and made available in reports, analyses and statistics: information about the web browser, IP address, time zone and some of the cookies installed on your device. When you navigate the website, information about the websites or products accessed, the referrer URL (website from which you accessed our website), and information about how you interact with the website is also collected.   1. Meta Ads

We use Meta Ads on our website, an online advertising program from Meta Platforms Inc., 1601 Willow Road, Menlo Park, CA, 94025, USA. When you use a meta platform, information about your behavior on the meta platform is collected and forwarded to us. This includes the number of people, information on demographics, interests of the people who interacted with the advertisements or products, etc., on which meta platform the advertisement was shown, for example. Information from which conclusions can be drawn about the person of the user or contact options are not shared with us.

X. Social Media Plug-ins

Based on your consent within the meaning of Art. 6 Paragraph 1 Letter a of GDPR, we use various social media plugins for web analysis, remarketing and retargeting to optimize our online presence and to be able to put together more targeted offers for you.

We use the social plugin of the social network facebook.com. This is operated by Meta Platforms Inc., 1601 Willow Road, Menlo Park, CA, 94025, USA ("Facebook"). The plug-ins can be recognized by a Facebook logo or are marked with the addition "Facebook Social Plugin". XI. Integration of videos via YouTube

We use videos from the company YouTube, LLC 901 Cherry Ave., 94066 San Bruno, CA, USA. Google Ireland Ltd. ("Google"), Google Building Gordon House, Barrow Street, Dublin 4, Ireland is responsible for data processing on YouTube. When you access a page from one of our products that has an embedded video (also available directly via YouTube), a connection is established to the YouTube servers and the content is displayed on the website by sending a message to your browser. The information on your website usage generated by the plug-in is transferred to a YouTube server in the USA and stored there. However, if IP anonymization is activated on this website, your IP address will be shortened beforehand by YouTube within member states of the European Union or in other contracting states to the Agreement on the European Economic Area. Only in exceptional cases will the full IP address be transmitted to a YouTube server in the USA and shortened there. On our behalf, YouTube will use this information to evaluate your website activities, to compile reports on this and to provide us with other services related to website and internet usage. According to YouTube, in "- extended data protection mode -" only data is transmitted to the YouTube server, in particular which of our product pages you have visited when you watch the video. XII. Use of Google Maps

We use the function for embedding Google Maps from Google Ireland Limited (“Google”), Gordon House, Barrow Street, Dublin 4, Ireland on our website.

The function enables the visual representation of geographical information and interactive maps. When pages that contain Google Maps are accessed, Google also collects, processes and uses data from website visitors. Your data may also be transmitted to the USA. The EU Commission has issued an adequacy decision for the USA, the Trans-Atlantic Data Privacy Framework (TADPF). XIII. Your rights

You have the following rights:

According to Art. 15 GDPR, you have the right to request information about your personal data stored by us, its origin and recipient, the purpose of the data processing, the planned duration of data storage including a copy of the personal data that is the subject of the processing, free of charge at any time.

Furthermore, according to Art. 16 GDPR, you have the right to have inaccurate personal data corrected immediately or to have incomplete personal data completed at any time.

According to Art. 22 GDPR, you have the right not to be subjected to a decision based solely on automated processing – including profiling – that produces legal effects concerning you or significantly affects you in a similar way.

According to Art. 77 GDPR, you also have the right to lodge a complaint with the competent supervisory authority.
